The Court of Appeal have drafted "... a comprehensive set of principles to be applied in personal injury cases ...".
Unfortunately they haven't published them as it was felt that there were serious doubts as to whether guidance on costs capping should emanate from the Court as opposed to being formulated by the Civil Procedure Rules Committee.
The set of principles were drafted by the Court before it gave Judgment in the case of Willis -v- Nicolson [2007-2008] EWCA Civ 199.
Despite the fact that the guidelines haven't been published the case is worth reading if you're dealing with a costs capping application.
Hopefully the Civil Procedure Rules Committee will produce some guidance at some stage.
