Knight -v- Beyond Properties PTY Limited and Others
This was an application relating to a Costs Capping Order where the Court decided that the principles relating to Costs Capping Orders which were laid down in King v Telegraph Group Limited were not applicable to all litigation.
The fact that the Claimant in this case was instructing solicitors under a CFA without after the event insurance cover was not by itself enough to justify a Cost Capping Order being made.
