There are two recently reported cases which may be of interest concerning issues relating to when a Legal Expenses Insurer is obliged to provide indemnity.
- In Webster Dixon & Ors v Equity Syndicate & Ors [2011] EWHC 2661 the claimant argued successfully that an insurer could not reject a policy holder's choice of solicitor simply because the solicitor's charging rate exceeded the rates proposed by the insurer.
- Pine v DAS Legal Expenses Insurers Ltd concerned the entitlement to indemnity in circumstances where the claimant had instructed the counsel of her choice in a negligence action.
