An interesting case was reported recently where the Court had considered whether the rejection of a Part 36 offer meant that it could not subsequently be accepted.
In Mr Roop Sampla and Ors -v- Rushmoor Borough Council and Mr Timothy Crowley the First Defendant made an Application for permission to accept a Part 36 offer (in respect of contribution) made by the Second Defendant that it had previously rejected.
The Court concluded that a Part 36 offer was not directly analogous to a contractual offer and that in principle a Part 36 offer could be accepted notwithstanding an earlier rejection.
